延边州招商引资奖励办法

Reward Measures for Investment Attraction of Yanbian Korean Autonomous Prefecture

第一条 为进一步加大招商引资工作力度，充分调动全州招商引资工作的积极性，加快推动延边振兴发展，根据《延边州招商引资优惠政策的指导意见》要求，结合我州实际，制定本奖励办法。

Article I These reward measures are formulated according to the requirements of the Guiding Opinions of the Preferential Policies for Investment Attraction in Yanbian Prefecture and based on the actual conditions of Yanbian Prefecture in order to further enhance the efforts in attracting investment, to mobilize the enthusiasm of the whole prefecture for investment attraction and to accelerate the revitalization and development of the Prefecture.

第二条 本办法奖励对象是指引进对全州经济发展具有重大带动作用，且投资额达5亿元以上的产业项目中，做出突出贡献的各类法人实体、社会组织机构和自然人（以下统称为引资人）

Article II The rewarding objects herein should be the various kinds of legal person entities, social organizations, public institutions and natural persons that or who make prominent contribution in attracting an industrial project with investment of over CNY 500 million that drives the economic development of the whole prefecture significantly (hereinafter referred to collectively as “investment attractors”).

第三条 申请条件

Article III Conditions for Application

（一）项目投资方与所在县（市）政府签订投资合同，且合同金额达5亿元以上（含5亿元）；

1. The project investor signs an investment contract with the government of the county (city) where the project is located, and the contract value should be CNY 500 Million or above;

（二）投资项目已完成立项、规划许可、用地、环评等审批手续；

2. The investment project has been approved, the planning permission has been obtained, and the examination and approval formalities for use of land and environmental assessment have been fulfilled;

（三）项目投资方已全部缴纳项目用地土地出让金；

3. The project investor has paid the land transfer fee for the project land in full;

（四）投资项目已经开工建设。

4. Construction of the investment project has commenced.

第四条　奖励标准

Article IV Reward Criteria

（一）引进投资额5—10亿元（含5亿元）项目的，给予引资人20万元奖励；

1. An attractor of a project valuing CNY 500 Million – CNY 1 Billion will get CNY 200,000 as reward.

（二）引进投资额10—20亿元（含10亿元）项目的，给予引资人30万元奖励；

2. An attractor of a project valuing CNY 1 Billion – CNY 2 Billion will get CNY 300,000 as reward.

（三）引进投资额20亿元（含20亿元）以上项目的，给予引资人50万元奖励。

3. An attractor of a project valuing CNY 2 Billion or more will get CNY 500,000 as reward.

第五条 引资人为州内机关、事业单位及公职人员的，按照相关政策兑现相应奖励。

Article V Where the investment attractor is an authority organ, a public institution or a civil servant within the Prefecture, the corresponding reward should be realized according to the relevant policy.

第六条 奖励考核工作由州招商引资工作领导小组办公室牵头组织，按以下程序进行：

Article VI The examination on and approval of reward should be organized under the leadership of the Leader Group Office for Investment Attraction of the Prefecture according to the following procedures:

（一）申报。由项目所在县（市）负责统一申报。申报时需提供投资企业营业执照、投资合同、项目审批文件（复印件），当地政府出具的项目开工证明，投资企业和当地政府出具的引资人证明。

1. Declaration. The county (city) where the project is located should be responsible for unified declaration. For declaration, the business license, the investment contract and the project approval document (hard copy) of the investment enterprise, the certification of commencement issued by the local government, and the certification of investment attractor issued by the investment enterprise and the local government should be provided.

（二）评审。领导小组办公室整理汇总申报材料，并召集州委组织部、州发改委、州工信局、州财政局、州人社局、州商务局、州文广旅局、州审计局等部门组成评审小组，对申报的引资人奖励情况进行初审。初审后提交州招商引资工作领导小组研究确定，然后提交州政府常务会议审定。其中，州商务局负责申报材料的整理汇总，负责商贸物流、总部经济项目的审核，负责奖励资金的发放；州发改委负责投资项目审批手续的审核；州工信局负责工业项目的审核； 州文广旅局负责全域旅游项目的审核；州委组织部、州人社局负责引资人为州内机关、事业单位及公职人员的奖励审核；州财政局负责奖励资金的筹措和监管；州审计局负责奖励资金发放的监督。

2. Appraisal. The Leader Group Office should sort out and summarize the declaration materials and convene the Organization Department of the Prefectural Party Committee, the Prefectural Committee of Development & Reform, the Prefectural Bureau of Industry and Information Technology, the Prefectural Bureau of Human Resources and Social Security, the Prefectural Bureau of Culture, Broadcasting and Travel and the Prefectural Audit Bureau to form an Appraisal Team which can appraise the reward to investment attractors declared initially. After the Appraisal Team makes the initial examination, the reward to investment attractors should be submitted to the Leader Group of Investment Attraction for determination and then to the Executive Meeting of the Prefectural Government for examination and approval. The Prefectural Commerce Bureau should be responsible for the sorting and summarization of declaration materials and the examination on and approval of commerce, trade, logistics and headquarter economy related projects and for the distribution of reward funds; the Prefectural Committee of Development and Reform should be responsible for the examination and approval formalities of the investment projects; the Prefectural Bureau of Industry and Information Technology should be responsible for the examination on industrial projects; the Prefectural Bureau of Culture, Broadcasting and Travel should be responsible for the examination on and approval of travel projects in the whole region; the Organization Department of the Prefectural Party Committee should be responsible for the examination on and approval of reward to authority organs, public institutions and civil servants within the Prefecture; the Prefectural Finance Bureau should be responsible for the raising of and supervision on the reward funds; and the Prefectural Audit Bureau should be responsible for monitoring the distribution of reward funds.

（三）公示。对引资人拟受奖励情况进行公示，公示期为5个工作日。

3. Publicity. The proposed reward for investment attractors will be made public for a period of five working days.

（四）兑现。公示期满，依据奖励政策兑现相应奖励。

4. Realization. The corresponding reward will be realized according to the reward policy after the publicity period expires.

第七条 州财政每年安排500万元奖励资金，由州本级组织实施，每年开展一次。

Article VII The Prefectural Finance Bureau will arrange CNY 5 Million as reward funds every year, and the rewarding will be organized by the Prefecture itself once a year.

第八条 引资人申请奖励应在项目落地且开工建设后1年以内完成，逾期视为引资人放弃奖励申请。

Article VIII An investment attractor should apply for reward within 1 year after the project is implemented and commences construction, otherwise, it should be deemed as having waivered the application for reward.

第九条 对在奖励过程中弄虚作假的，一经发现，取消奖励资格，追回奖励资金，并依法依规追究相关人员责任。

Article IX Once any falsification made during the reward process is found, the reward qualification should be cancelled, the reward funds should be taken back, and the responsibilities of related personnel should be investigated in accordance with the law.

第十条 本办法由州商务局负责解释。

Article X These measures should be interpreted by the Prefectural Commerce Bureau.

第十一条 本办法自发布之日起施行。

Article XI These measures should be executed as of the release date.
